you agree to all of the terms and conditions of this Agreement as
outlined below.
Please read all
of the following terms and conditions carefully, as they define
the legally binding terms of your membership. By using this service
you are agreeing to be bound by this Agreement. You must agree
to abide by all of the terms and conditions contained in this
Agreement in order to become or remain an authorized user of Persian-Café.
If you do not agree to these terms and conditions, you may
not use the service and should not proceed to register. This
agreement may be modified by Persian-Café from time to
time effective upon notice to you as a member.
Your right to
use this service is subject to some limitations, conditions and
restrictions established by us from time to time, at our sole
discretion. You understand and agree that Persian-Café
may delete any content, database, messages or photo profiles.
Persian-Café reserves the right but shall have no obligation
to remove materials from the Service that do not comply with this
service agreement. We may alter, suspend or discontinue any aspect
of this service at any time, including the availability of any
service feature, database or content. We may also impose limits
on certain features and aspects of this service or restrict your
access to parts or all of this service without notice or liability.
You are responsible for all usage or activity on this service
by users using your password, including but not limited to use
of your password by any third party.
Persian-Café
does not monitor or resolve disputes between users of the service.
Persian-café reserves the right, but has no obligation,
to monitor disputes between you and other members. You are solely
responsible for your interactions with other members.
You agree to use
this service in accordance with the following Code of Conduct:
- Persian-Café
is an adults only service. You must be at least eighteen years
old to use this service.

You are solely responsible for the content that you publish
or display on this service.
- You
will not post any photos, which contain nudity, obscene images,
personal information, libelous, slanderous, abusive or defamatory
statements, or racist, pornographic or offensive language.
- You
will not use this service to engage in any form of harassment
or offensive behavior.
- You
will not post any photos, messages or recordings that violates,
plagiarizes or infringes upon the rights of any third party,
including but not limited to any copyright or trademark law,
privacy or other personal or proprietary rights.
- You
will not forward chain letters, send junk mail or spam through
this service.
- You
will not use this service to distribute, promote or publish
material containing any advertising or solicitation for goods
and/or services.

You will keep all information provided to you through Persian-Café
as private and confidential and will not give such information
to anyone without the permission of the person who provided
it to you.
- You
will not use this service to infringe the privacy rights, property
rights, or any other rights of any person.
- You
will not use this service to distribute or upload any virus,
trojan horses or do anything else that might cause harm to this
service in any way.
- You
will not use this service to promote any illegal or unauthorized
copy of another person's copyrighted work such as pirated computer
programs or links to them, or providing pirated music or links
to pirated music files.
- You
will not use this service to solicit passwords or personal information
for commercial or unlawful purposes from other users.
- You
may not use the service for any unlawful purpose. We may refuse
to grant you access to this service if your user ID or nickname
impersonates someone else, which is protected by trademark or
proprietary law, or is vulgar or otherwise offensive.
- You
will not post any last names, telephone numbers, street addresses,
URL's and/or e-mail addresses in your profile.
No Warranties
- Persian-café is distributed on an "as is basis".
We do not warrant that this service will be interruption- or error-free.
You acknowledge that use of this service is at your own risk.
Persian-café is not responsible for any incorrect or inaccurate
content posted on this Site, whether caused by users, members
or by any of the equipment associated with or utilized by this
service. Persian-café assumes no responsibility for any
error, omission, interruption, deletion, defection, or delay in
operation or transmission, communication lines failure, theft
or destruction or unauthorized access to user or member communications.
Persian-Café does not ensure secure transmissions over
the Internet.
Persian-café
does not represent or endorse the accuracy or reliability of any
advice, opinion, statement or other information displayed, uploaded,
or distributed through this service by Persian-café or
any user of this service. You acknowledge that any reliance upon
any such opinion, member profile, advice, statement or information
shall be at your sole risk.
No Responsibility
- You acknowledge that we are not responsible for the suspension
of this service, regardless of the cause of the interruption or
suspension. Any claim against us shall be limited to the amount
you paid, if any, for the use of this service. We may discontinue
or change this service or its availability to you at any time,
and you may stop using this service at any time.
Limitation
on Liability - In no event will Persian-café be liable
to you or any third person for any indirect, consequential, exemplary,
incidental, special or punitive damages (including but not limited
to, lost profits arising from your use of the Site or this service,
loss or programs, loss of data), even if Persian-café has
been advised of the possibility of such damages. Notwithstanding
anything to the contrary contained herein, Persian-café's
liability to you for any cause whatsoever, and regardless of the
form of the action, will at all times be limited to the amount
paid, if any, by you to Persian-café for this service during
the term of membership.
Indemnity -
You agree to indemnify and hold Persian-café, its affiliates,
officers, directors, and other partners and employees, harmless
from any loss, liability, claim, or damages including reasonable
attorney's fees, made by any third party due to or arising out
of your use of this service in violation of this Agreement and/or
arising from a breach of these Terms of Use and/or any breach
of your representations and warranties set forth above.
Modifications
- We may modify this Agreement from time to time at our sole
discretion. Notification of changes in this agreement will be
posted on this service or sent via electronic mail. If you do
not agree with any modifications, you should terminate your use
of this service.
Privacy -
Persian-café does not ensure the security or privacy of
information you provide through the Internet and your email messages,
and you release use from any and all liability in connection with
the use of such information by other parties. Persian-café
is not responsible for, and cannot control, the use by others
of any information, which you have provided to them. Persian-café
cannot assume any responsibility for the content of messages sent
by other users of this service and you release us from any and
all liability in connection with the contents of any communications
that you may receive from other users. Persian-café cannot
guarantee, and assumes no responsibility for verifying the accuracy
of the information provided by other users of this service.
Fee and Payments
- All fees and charges are non-refundable. You are responsible
for paying any and all amounts billed to your credit card by a
third party. You are also responsible for any fees or charges
incurred to access this service through an Internet access provider,
including but not limited to telephone charges.
Disclosure
- We reserve the right to send electronic mail to you for
the purpose of informing you of changes or additions to this service
or any related products and services. We reserve the right to
disclose information about your usage of this service and demographics
in forms that do not reveal your personal identity.
Disputes -
If there are any disputes about or involving the Site and/or this
service, you agree the dispute will be governed by laws of the
State of California. The parties agree specifically that the performance
of this agreement, in all aspects, does not take place outside
the jurisdiction of the State of California, USA.
